Welcome to Until Next Tee LLC ("Until Next Tee", "we", "us", or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("Member", "User", "you", or "your") and Until Next Tee LLC governing your access to and use of our website at https://untilnexttee.com, our 24/7 unmanned indoor golf simulator facility, our autonomous conversational SMS concierge, and any related club services.

By purchasing a membership, booking a simulator bay, using a door access PIN, accessing our facility premises, or interacting with our automated SMS concierge service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using our services and entering the facility.

1. 24/7 Unmanned Facility & Keyless Entry

• Unmanned Operation Notice: Until Next Tee is operated as a private, automated, 24/7 unmanned luxury golf club. There are no on-site attendants, staff members, or security personnel present during regular operating hours. Members and guests acknowledge that they enter and utilize the facility entirely at their own discretion and risk.
• Emergency Procedures: In the event of an emergency, medical situation, fire, or physical threat, members and guests must immediately call 911. A basic first aid kit and an Automated External Defibrillator (AED) are situated near the front entrance lounge.
• Keyless PIN Access: Access to the facility is granted strictly via an automated, single-use 4-digit PIN code issued via SMS to your registered mobile phone 1 hour prior to your confirmed tee time. The PIN expires automatically at the conclusion of your reservation window.
• Access Security & Anti-Tailgating: Members are strictly prohibited from sharing their personal door PIN, distributing entry codes, propping doors open, or admitting unauthorized individuals. Unauthorized entry or "tailgating" will result in immediate termination of membership without refund and potential civil or criminal trespass charges.
• Guest Access & Mandatory Waiver: Active members in good standing may bring up to three (3) guests per reserved bay (maximum of 4 golfers per bay at any time). Every guest must complete and digitally sign the Digital Liability Waiver & Safety Agreement at untilnexttee.com/waiver before entering the hitting bay or swinging a club. The host member is jointly and severally liable for all actions, conduct, injuries, and damages caused by their guests.

2. Simulator Bay Booking & Fair Usage Rules

• Maximum Active Bookings: To prevent slot hoarding and ensure equitable access for the entire club, an active member may hold a maximum of three (3) concurrent active reservations on the schedule at any given time across the facility. A 1-hour or 2-hour scheduled session counts as one (1) reservation. Once a scheduled session has concluded, that booking slot immediately refreshes and an additional reservation may be made.
• Facility-Wide Daily Limit: To protect availability and prevent prime-time monopolization, members may book a maximum of two (2) total hours per calendar day across the entire facility, regardless of bay selection. Hopping between bays or scheduling multiple sessions to exceed two hours of play in a single calendar day is strictly prohibited.
• Session Duration & Advance Window: Individual reservations may be scheduled in 1-hour, 1.5-hour, or up to 2-hour blocks, up to fifteen (15) days in advance via our SMS Concierge.
• Cancellations & Ghost Reservations: Members may cancel or reschedule reservations anytime via SMS to the Concierge. Cancellations must be made at least two (2) hours prior to the reservation start time whenever possible. Repeatedly holding reservations that are not utilized ("ghost bookings") degrades club availability and may result in temporary booking restrictions or suspension.
• Punctuality & Transition: Members must conclude their swings and vacate the hitting bay promptly at the scheduled end time to allow the incoming member immediate access to their reserved slot.

3. Property Damage, Equipment Care & "Card on File" Authorization

• Clean Clubs & Approved Balls Only: Members and guests must inspect and clean golf clubs prior to use. Clubs with dirt, sharp burrs, or outdoor debris are strictly prohibited. Golfers must use only the clean, unmarked, premium golf balls provided at each bay. Striking cut, marked, scuffed, or personal outdoor balls into screens is strictly forbidden as they permanently damage impact surfaces.
• Approved Footwear: Only clean spikeless golf shoes, clean sneakers, or athletic footwear are permitted on facility turf. Metal spikes, work boots, dress shoes, and dirty outdoor footwear are prohibited.
• Full Financial Responsibility: The member agrees to exercise utmost care when using all facility equipment. The host member assumes complete financial liability for any damage, loss, or destruction of club property, impact screens, launch monitors, cameras, projectors, electronics, furnishings, or the facility itself resulting from negligence, reckless swinging, horseplay, violation of safety rules, or improper equipment used by the member or their guests.
• Express Authorization to Charge Card on File: By accepting these Terms, the Member expressly authorizes Until Next Tee LLC to immediately charge the credit/debit card on file with our payment processor (Stripe) for the actual, documented cost of inspection, repair, or full replacement of any property or equipment damaged due to the acts, omissions, or rule violations of the member or their guests, plus any associated administrative and out-of-service operational losses.

4. Facility Conduct, Safety Rules & Strict No-Alcohol Policy

• Single Golfer Enclosure Rule: Only one (1) player is permitted inside the turf hitting enclosure at any time. All other guests and players must remain behind the yellow boundary safety line in the lounge seating area. Never step ahead of the hitting mat while another golfer is addressing the ball or swinging.
• Strict No-Alcohol & Zero-Intoxication Policy: In compliance with Washington State law and facility safety regulations, alcoholic beverages of any kind are strictly prohibited on the premises. Members and guests may not bring, possess, or consume beer, wine, spirits, or any alcoholic drinks inside the facility. Furthermore, entering the premises while intoxicated or under the influence of drugs, alcohol, or controlled substances is strictly forbidden. Until Next Tee maintains a zero-tolerance policy; any violation will result in immediate session cancellation, permanent membership termination without refund, forfeiture of facility access, and potential legal trespass notification.
• Smoke-Free, Cannabis-Free & Weapon-Free Facility: Smoking, vaping, electronic cigarettes, cannabis / THC consumption of any kind, and firearms or weapons of any kind are strictly prohibited on the premises.
• Cleanliness & Respect: Members must dispose of all trash, bottles, cans, and personal belongings before exiting. Leave the bay in pristine condition for the next player.

5. 24/7 Closed-Circuit Video Surveillance (CCTV)

To protect the safety of all members, verify authorized access, ensure compliance with safety rules, and safeguard facility technology, the premises of Until Next Tee are monitored by 24/7 closed-circuit television (CCTV) and video recording systems at all times.

By entering the facility, you and your guests expressly consent to being recorded by our security cameras. Security footage is securely archived and may be reviewed by management for incident investigation, damage attribution, occupancy verification, and provided to law enforcement authorities in the event of criminal conduct, property damage, or emergency situations. 7. Billing, Subscriptions, Pauses & Cancellations

• Recurring Monthly Billing: Memberships are billed automatically on a recurring monthly cycle via Stripe. Your subscription will renew each month unless cancelled prior to your billing renewal date.
• Founding & Standard Memberships: Founding Member pricing ($149/mo) is guaranteed for the lifetime of active continuous enrollment and is non-transferable. Standard Memberships renew at the posted rate ($199/mo). If a membership lapses or is terminated for non-payment, reinstatement is subject to prevailing standard rates and waitlist availability.
• Self-Service Cancellation: You may cancel your month-to-month membership at any time with zero cancellation fees or long-term commitments. Upon cancellation, your access remains valid through the conclusion of your current paid billing period.
• Refund Policy: All membership dues, reservation fees, and charges are strictly non-refundable once billed, except where required by law.
• Right to Revoke: Until Next Tee LLC reserves the right to immediately suspend, blackout, or terminate any membership without refund in the event of rule violations, abusive conduct, property damage, or non-payment.

8. Assumption of Risk & Comprehensive Release of Liability

Golf simulation, ball-striking, and related athletic activities carry inherent risks, including but not limited to ricocheting golf balls, detached club heads, broken shafts, slips, trips, falls on turf, and physical exertion. By entering the facility and using the simulators, you and your guests knowingly, freely, and voluntarily assume all risks, known and unknown, associated with your presence on the premises.

To the fullest extent permitted by law, you hereby release, waive, forever discharge, and agree to hold harmless Until Next Tee LLC, its owners, officers, managers, agents, employees, building landlords, and affiliates from any and all claims, liabilities, demands, losses, or damages for personal injury, illness, paralysis, death, or property loss arising out of or related to your participation or presence on the premises, whether caused by the active or passive negligence of Until Next Tee LLC or otherwise.

9. Dispute Resolution: Mandatory Binding Arbitration & Class Action Waiver

• Governing Law & Venue: These Terms and any dispute arising between you and Until Next Tee LLC shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Spokane County, Washington.
• Mandatory Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms, facility access, property damage, personal injury, or membership shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration shall take place in Spokane County, Washington, before a single neutral arbitrator. The arbitrator's award shall be final and binding.
• Class Action & Jury Trial Waiver: You and Until Next Tee LLC agree that each party may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. Both parties expressly waive any right to a trial by jury.
• One-Year Limitation Period: Any cause of action or claim you may have arising out of or relating to these Terms or the facility must be commenced within one (1) year after the cause of action accrues; otherwise, such claim is permanently barred.
